Employer Nomination Scheme Visa (Subclass 186) – Information

The Australian Employer Nomination Scheme (Subclass 186) is a special visa issued to foreigners who wish to reside permanently in Australia. This visa was launched in 2012 as a replacement for the previous Subclass 873 Visa and Subclass 883 Visa, with some changes in the streamlining processes.

In order to apply for the Australian ENS Visa, you need to have the necessary skills for the position and meet the crucial health and character requirements. This visa is sponsored by Australian employers who must demonstrate their ability to contribute to the nominated workers’ development in Australia.

Direct Entry Stream

Temporary Residence Transition Stream

  • Be nominated by an Australian employer with an active and lawfully operating business who is a party to a labor agreement with the nominated employee.

You cannot obtain an Australian visa if:

  • Your nomination is withdrawn
  • The position is no longer available

Temporary Residence Transition Stream

For an Australian visa, you must:

  • Be under 45 years of age.
  • Have suitable English skills.
  • Meet the official health requirements.
  • Meet the official character requirements.
  • Perform work relevant to the eligible occupations list.
  • Participate in the skill assessment to prove your nominated skills for the visa.
  • Be nominated by an Australian employer sponsoring your Temporary Work Visa.
  • Obtain a license or registration from the authorities of the state you intend on visiting.
  • Be sponsored to work full-time on the Subclass 457 Visa or Subclass 482 Visa for at least 3 years prior to nominating you for the Employer Nomination Scheme (Subclass 186 Visa).

If you are willing to bring your sibling to Australia and you are an Australian citizen or permanent resident, you can do it through different visa options.

While there is no special sibling visa to Australia, there are several visa types that allow siblings of Australian citizens, permanent residents, and New Zealand citizens to live in Australia: a visitor visa (subclass 600), a skilled work regional visa (subclass 491), remaining relative visa (subclass 115/subclass 835), and a carer visa (subclass 116/836).

Requirements vary between types, yet, usually, a sponsoring sibling must be at least 18 years old and agree to provide financial support. Applicants and siblings who are planning to move to Australia must meet health and character requirements.

Usually, under an Australian sibling visa, you can bring not only your full or half-siblings but also adoptive siblings or step-siblings.

Family-Sponsored Visas

Here you can review different family-sponsored visa options under which it is possible to bring your sibling to Australia. Examine each family-sponsored visa and its requirements to see which option applies to your situation.

Subclass 600 – Visitor Visa

Consider subclass 600 Visitor Visa (Sponsored Family Stream) if you want your sibling to visit Australia short-term. This visa allows to come to Australia for sightseeing, vacationing, studying, and meeting relatives and friends. Employment under a visitor visa is forbidden.

It is possible to remain in Australia for up to 3 months in total, so this visa type is suitable for those who plan to stay in the country temporarily. If your sibling is willing to reside in Australia for an extended period, opt for other family visas.

Requirements for a visitor visa (subclass 600) 

To sponsor any relatives, including siblings, a person must meet the following conditions:

  • be an Australian citizen or permanent resident
  • be 18 years old or over
  • be able to pay a security bond if requested by the Department (usually between $5,000 – $15,000 per person)

Subclass 491 Skilled Work Regional (Provisional) Visa – Family Sponsored

The subclass 491 visa was launched for skilled workers and their relatives to live, work, and study in designated regional areas of Australia. It permits to stay in Australia for up to 5 years. After 3 years of holding this visa it is also possible to apply for a Permanent Residence.

Eligibility requirements

A sponsor has to be:

  • at least 18 years old
  • reside in a designated area of Australia
  • be a settled Australian citizen, an Australian permanent resident, or an eligible New Zealand citizen

Under a skilled work regional visa, you can sponsor your brother, sister, adoptive brother, adoptive sister, step-brother, or step-sister.

Besides, it is also possible to sponsor an eligible parent, dependent child or step-child, aunt, uncle, adoptive aunt/uncle, step-aunt or step-uncle, nephew, niece, adoptive nephew/niece, step-nephew or step-niece, grandparent, or a first cousin.

A sponsored applicant must meet such requirements:

  • gain a minimum of 65 points in the Australia PR Points System
  • be under 45 years old
  • have competent English
  • take skills assessment
  • pass character requirement
  • confirm good health through a health examination
  • their occupation must be on the MLTSSL list

Subclass 115/Subclass 835 Remaining Relative Visa

A remaining relative visa is available in subclass 115 and subclass 835. Subclass 115 is suitable for applicants who are outside Australia, while subclass 835 is for applicants who are in Australia at the moment of submitting the visa application.

Subclass 115/subclass 835 remaining relative visa allows to stay, work, and study in Australia permanently.

Conditions to satisfy for a remaining relative visa 

An applicant must fulfill such conditions:

  • be sponsored by an eligible family member – sibling or step-sibling, eligible parent or step-parent, or an eligible partner of the relative
  • have no other close family members – parents/step-parents, partner’s parent/step-parent, sibling/step-sibling, child/step-child of 18 years old or older who is not dependent on the applicants, a child/step-child who is under 18 and not in applicant’s or their partner’s daily care and control
  • pass health and character requirements
  • must have assurance of financial support

Subclass 116/Subclass 836 Carer Visa

An applicant for a 116/838 family-sponsored visa has to:

  • provide ongoing significant care and support for the sponsoring relative or the family member
  • meet health and character requirements

To be a sponsor, an individual must:

  • be medically assessed as someone who needs continuous medical care
  • show that they cannot get adequate care from other options – from other family members, an Australian welfare, hospital, or community service

Australia is quite a popular destination to consider when looking for employment opportunities if you are a skilled professional. The Australian government introduced several visa options to facilitate foreign immigrants moving to Australia and working there. Nevertheless, there are two main pathways that skilled workers may consider if they plan to work and live in Australia. These paths include the Skilled Nominated Visa 190 and the Independent Visa 189.

While both visa types are dedicated to skilled individuals, there are specific differences in visa eligibility criteria, the process of application, etc. Let’s take a closer look at the main differences between these immigration paths to compel any doubts regarding what visa type suits better your particular needs.

Difference between 189 and 190 visa

Skilled Independent Visa (subclass 189) vs. Skilled Nominated Visa (subclass 190)

This is probably the most often asked question by those considering moving to Australia. Therefore, the main difference between these two visas is the fact that the Skilled Independent Visa (189) requires no sponsorship. At the same time, a state or territory must sponsor an applicant for the Skilled Nominated Visa (190).

Holders of ‘sponsored’ visas have some obligations regarding their place of living, while those who hold an independent visa do not have such responsibilities.

The Skilled Nominated Visa obligations are as follows:

  • receiving a nomination from the Australian state or territory (it means making an additional application to the state/territory and meeting their individual eligibility requirements);
  • moving to a nominated state/territory within 6 months of the moment you have moved to Australia;
  • living and working in the nominated state/territory for at least 2 years.

There are also two main differences between the visas subclass 189 and 190:

  • The occupation nominated for subclass 190 visa must be one of these present on the Combined List of Eligible Skilled Occupations; the occupation for visa subclass 189 must be chosen from the ‘MLTSSL’;
  • Holding a 190 visa gives an additional 5 points towards the points test factors if one is short of receiving the minimum score.

Application for a Skilled Independent Visa (189) and a Skilled Nominated Visa (190)

Step 1: Skills Assessment

  • Subclass 189 visa: applicants choose an occupation from the Medium and Long Term Strategic Skills List.
  • Subclass 190 visa: applicants choose an occupation from the Combined List of Eligible Skilled Occupations.

Once the applicant has chosen an occupation, they must pass a skills assessment (if their qualifications were not obtained in Australia). A specific assessing authority is responsible for conducting the evaluation.

Step 2: Submit an Expression of Interest

Once you have chosen the occupation and completed the skills assessment, the next step will be to lodge an Expression of Interest via the government’s Skill Select service (this step is common for both subclass 189 visa and subclass 190 visa).

The EOI requires providing certain information, such as your:

  • standard personal data
  • occupation you wish to nominate
  • occupational background (work experience)
  • education
  • English skills
  • business and investment experience
  • skills assessment (about the nominated occupation)

There is also a minimum score of 65 points on test factors that one must achieve to lodge an Expression of Interest. These points can be received for age, one’s English skills, skilled employment, particular qualifications, and others.

Step 3: State Sponsorship Application (only for 190 visas)

This step only applies if someone requests a Skilled Nominated Visa (190). Every state or territory has its own job lists. That is why 190 visa applicants must lodge a state sponsorship application. Applicants can indicate which state or territory they wish to work and live in.

The aim of state sponsorship application is not to link an applicant directly with an individual employer but to locate them in a particular state, especially one with a shortage of specialists with specific skills.

Depedning on the selected state or territory in Australia, the requirements may differ.

Step 4: Online Application

Once your EOI is successful, you will receive an invitation to apply for either a Skilled Independent Visa or a Skilled Nominated Visa. You will have 60 days to submit your visa application when you receive this invitation. During these 60 days, you cannot change the submitted EOI.

About Skilled Independent visa

Skilled Independent visa subclass 189 is a visa designed for invited workers, eligible New Zealand citizens, and eligible Hong Kong or British National (Overseas) passport holders with relevant skills to live and work permanently in any part of Australia.

It is possible to apply either onshore or offshore of Australia. Applicants can include dependent family members such as spouse/partner and dependent children.

A skilled independent visa permits you to live and work/study permanently in Australia, enroll in Medicare, Australia’s scheme for health-related care and expenses, get access to some social security payments, and lodge an application for Australian citizenship once you meet relevant requirements.

Important: Skilled Independent visa subclass 189 has been closed to new applications from primary applicants from 1 July 2023.

Skilled Independent visa

Skilled Independent visa requirements

To be able to apply for a 189 Australian visa, you need to satisfy the following conditions:

  • Hold a visa: if you are in Australia at the moment of applying, you need to have a substantive visa, Bridging visa A, Bridging visa B, or Bridging visa C; if you currently have, or your last substantive visa was a Skilled Work Regional (Provisional) or Skilled Employer Sponsored Regional (Provisional), you must have held that visa for a minimum 3 years when applying;
  • Have a suitable skills assessment: you should provide a skills assessment copy for an applicant’s nominated skilled occupation within the 60-day period of invitation;
  • Be of acceptable age: you must be under 45 when you get an invitation to apply for the visa;
  • Get enough points in a test: your score must be higher than 65 points;
  • Have a sufficient level of English language: have competent English proven by a relevant test result;
  • Meet the skills requirement: your occupation must be in the list of eligible skilled workers occupations for the subclass 189 visa;
  • Have health examination: you must meet minimum health standards and pass medical assessment;
  • Meet the character requirement: applicants and family members aged 16 years and over must provide proof of a clean criminal record and truthfully answer all questions.

Note: Sometimes, your occupation may not be on the skilled migration occupation list. If this is the case, you need to think about what other occupations may be related to yours and look them up in the list. If another related occupation is in high demand and you fulfill the requirements for it, it may be your chance to get a Skilled Independent visa. For instance, if your occupation is civil engineer, you may look at the structural engineer, and if you are a livestock farmer, you may consider a dairy farmer occupation.

How to get a Skilled Independent visa

In order to obtain a Skilled Independent visa, you need to follow this step-by-step instruction:

  1. Check your eligibility: Review the list of eligible occupations and see whether your occupation is present; all applicants for an 189 visa to Australia must have at least 65 points in the skilled migration points test.
  2. Submit an expression of interest. You should let the authorities know you would like to obtain an 189 visa.
  3. Wait for the invitation: You will be ranked along with other applicants. If Australian authorities choose you, you will be invited to apply for the visa.
  4. Collect the documents. You need to prepare the required documents, 2 face photographs, including identity proof, Skills Assessment Report, English Language Test results, Character certificate, and other documents.
  5. Submit the 189 visa application. You need to apply within 60 days of receiving the invitation.
  6. Await the decision. You will be notified about the visa outcome in writing. You can be in or outside Australia while waiting for the processing of your visa application but not in immigration clearance.

When you are granted a visa, you will receive your visa grant number, information on the date when your visa validity begins, and your visa conditions. If you are outside Australia when the visa is approved, you need to enter Australia before the validity start date specified on your 189 visa grant letter.

In case of refusal, you will be notified why your visa application is rejected and whether you have a right to a review of the decision. Keep in mind that if your application is refused, your visa charge won’t be refunded.

How many PR Points are required for an Australian Visa?
